Terms of Service

SECTION 1 - ELIGIBILITY AND USE OF THE SERVICE

You may use MyGraceSong only if you can legally enter into a binding agreement. If you use the service on behalf of another person, organization, church, ministry, or family, you confirm that you have authority to do so.

You are responsible for the information you submit, including names, stories, recipient details, song preferences, photos, and contact information. You agree that the information you provide will be accurate, lawful, and submitted with any permissions required from the people described or depicted.

SECTION 2 - WHAT MYGRACESONG PROVIDES

MyGraceSong creates custom Christian songs from the story, occasion, and preferences you provide. The service may use human review, music production tools, audio hosting, email delivery, analytics, and payment providers to create and deliver your order.

Our songs are created using a combination of proprietary technology and AI-assisted tools. The final product is a unique composition based on the information you provide.

Custom creative work is subjective. We work to create a meaningful result, but we cannot promise that a song will match a specific imagined melody, vocal style, emotional reaction, production style, or personal expectation.

SECTION 3 - ORDER ACCEPTANCE

Submitting an order and payment does not require us to fulfill every request. We may reject, cancel, or ask you to revise an order if the request is incomplete, unlawful, unsafe, abusive, outside the scope of the service, technically impractical, or inconsistent with these Terms.

Once payment is processed and fulfillment begins, cancellation may no longer be available because each order requires custom work. If we cancel an order before meaningful work begins, we may issue a refund to the original payment method.

SECTION 4 - PRICING, TAXES, AND PAYMENT

Prices are shown at checkout and may change from time to time. The amount charged for your order is the amount displayed when you complete checkout, plus any applicable taxes, fees, currency conversion charges, or payment-provider charges.

Payments may be processed by a third-party payment provider or merchant of record. By purchasing, you authorize the payment provider to charge your selected payment method and you agree to provide accurate billing information.

SECTION 5 - DELIVERY AND ACCESS

Delivery is made by providing access to a digital song link, download link, listening page, email notification, or similar access method. Delivery is considered complete when the access method is made available to you, even if you do not open the email, click the link, download the file, or listen to the song.

Delivery timelines are estimates unless expressly stated otherwise. Standard delivery and rush delivery may be affected by incomplete customer information, technical issues, third-party provider outages, content review, payment review, or events outside our control.

You are responsible for checking spam, promotions, filters, and the accuracy of the email address you submit. We do not guarantee indefinite hosting, permanent file storage, ongoing access to every link, or re-delivery after a link expires or becomes unavailable.

SECTION 6 - CUSTOMER CONTENT AND PERMISSIONS

You keep your rights in the stories, photos, names, messages, and other materials you submit. You grant MyGraceSong permission to use those materials as needed to operate, create, review, deliver, support, secure, improve, and document the service.

If you submit information about another person, including a recipient, family member, church member, public figure, child, or deceased person, you confirm that you have the rights, permissions, or lawful basis needed to provide that information and request the song.

You must not submit private, sensitive, defamatory, exploitative, or unlawful material about another person without proper authority.

SECTION 7 - RIGHTS IN DELIVERED SONGS

After your order is paid and delivered, you may use the delivered song for personal, family, gift, devotional, church, memorial, celebration, and non-commercial sharing purposes.

You may not resell, sublicense, commercially distribute, monetize, claim exclusive ownership over underlying tools or templates, or use the delivered song in paid advertising, commercial media, political campaigns, or public broadcast without our prior written permission.

MyGraceSong may retain internal copies, metadata, logs, drafts, prompts, and operational records as needed for support, quality control, compliance, dispute handling, and service improvement.

SECTION 8 - MYGRACESONG CONTENT AND BRAND

The MyGraceSong website, brand, logo, design, text, sample songs, workflows, software, templates, graphics, and other service materials are owned by us or our licensors.

You may not copy, scrape, reproduce, modify, reverse engineer, resell, or use our service materials except as expressly allowed by these Terms or with our written permission.

SECTION 9 - CONTENT SAFETY AND PROHIBITED REQUESTS

You may not submit, request, create, or use the service for hateful, discriminatory, demeaning, harassing, abusive, threatening, exploitative, sexually explicit, violent, unlawful, defamatory, or intentionally misleading content.

This includes content that attacks, threatens, celebrates harm toward, dehumanizes, or excludes people based on race, ethnicity, national origin, religion, caste, disability, disease, age, sexual orientation, sex, gender, gender identity, veteran status, immigration status, or another protected or vulnerable characteristic.

If we determine that an order includes prohibited content, we may reject the request, ask you to revise it, cancel the order, suspend access, refuse delivery, or determine refund eligibility based on the order status, work already performed, payment-provider requirements, and applicable law.

SECTION 10 - CUSTOMER CONDUCT

You agree not to misuse the service, interfere with its operation, attempt unauthorized access, upload malicious code, scrape the site, impersonate another person, submit fraudulent payment information, abuse refunds or chargebacks, or use the service in a way that could harm MyGraceSong, customers, providers, or the public.

We may limit, suspend, or terminate access if we believe your use violates these Terms, creates risk, or could expose us or our providers to legal, operational, payment, or reputational harm.

SECTION 11 - THIRD-PARTY SERVICES

We rely on third-party services for payments, hosting, email, analytics, audio production, storage, security, and related functions. These providers may have their own terms, policies, uptime limits, review processes, and compliance obligations.

We are not responsible for third-party outages, delays, denials, account reviews, provider errors, provider policy changes, or payment-provider decisions outside our reasonable control.

SECTION 12 - PRIVACY

Our Privacy Policy explains how we collect, use, disclose, and protect personal information. By using the service, you acknowledge that you have read the Privacy Policy and understand that your information may be processed by service providers that help us operate MyGraceSong.

Do not submit information that you are not authorized to share. If you ask us to delete or access information, we will handle the request according to our Privacy Policy and applicable law.

SECTION 13 - REVIEWS, TESTIMONIALS, AND FEEDBACK

If you send feedback, reviews, testimonials, ideas, suggestions, or public comments, you allow us to use, edit, display, reproduce, and share them for operating, improving, and promoting MyGraceSong, unless we separately agree otherwise.

You are responsible for making sure your feedback is truthful, lawful, and does not infringe or violate another person's rights. We may decline to publish or remove feedback at any time.

SECTION 14 - ERRORS AND CHANGES

We may correct errors, inaccuracies, or omissions on the site, including pricing, descriptions, delivery estimates, availability, promotions, or product details. If an error materially affects your order, we may contact you, revise the order, cancel the order, or provide another reasonable remedy.

We may update, change, pause, or discontinue parts of the service at any time.

SECTION 15 - REFUNDS AND CANCELLATIONS

Because MyGraceSong creates custom digital products, orders are generally final once work has begun or delivery has occurred. If you are not satisfied, you must contact support@mygracesong.com within 10 days after payment so we can review your request.

If you would like changes to your delivered song, a revision may be requested by contacting support@mygracesong.com. Revisions are subject to a $29 fee per revision and are processed at our discretion based on feasibility. Revision fees are non-refundable once the revised song has been delivered.

We may offer a re-delivery, partial refund, full refund, or another resolution at our discretion. Rush delivery, priority handling, revisions, add-ons, and upgrades are generally non-refundable once purchased, except where required by law or where we determine a refund is appropriate.

Approved refunds are issued to the original payment method. Processing times depend on the payment provider and financial institutions. Payment processor fees, third-party production costs, or fulfillment costs may be non-refundable where permitted by law.

If you believe a charge is incorrect, contact us first at support@mygracesong.com. We reserve the right to dispute chargebacks that we believe are mistaken, abusive, or fraudulent.

SECTION 16 - NO PROFESSIONAL OR RELIGIOUS ADVICE

MyGraceSong is a creative gift and music service. Songs, lyrics, delivery notes, and website content are not professional counseling, pastoral advice, legal advice, medical advice, or financial advice.

You are responsible for deciding whether the content is appropriate for your intended recipient, event, church, family, or setting.

SECTION 17 - DISCLAIMERS

The service is provided on an as-is and as-available basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, perfect accuracy, and error-free delivery.

We do not guarantee that every draft, lyric, vocal, instrumental element, mix, file, link, or final output will be free from imperfections, subjective mismatch, provider limitations, or technical artifacts.

SECTION 18 - LIMITATION OF LIABILITY

To the fullest extent permitted by law, MyGraceSong, its owners, employees, contractors, service providers, and licensors will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, emotional distress, reputational harm, or missed event opportunities.

To the maximum extent permitted by law, our total liability for any order will not exceed the amount you paid for that order, minus any refunds, chargebacks, credits, payment-provider fees, and third-party fulfillment costs.

SECTION 19 - INDEMNIFICATION

You agree to defend, indemnify, and hold harmless MyGraceSong and its owners, employees, contractors, service providers, and licensors from claims, losses, liabilities, damages, costs, and expenses arising from your content, your misuse of the service, your violation of these Terms, your violation of law, or your violation of another person's rights.

SECTION 20 - TERMINATION

We may suspend or terminate access to the service at any time if we believe you violated these Terms, created risk, submitted prohibited content, abused payment or refund processes, or used the service in a way that could harm us or others.

Sections that by their nature should continue after termination will continue, including provisions about intellectual property, customer content, prohibited uses, payment obligations, disclaimers, limitations of liability, indemnification, disputes, and contact information.

SECTION 21 - DISPUTES AND GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is established, without regard to conflict-of-law rules. If a dispute cannot be resolved informally, it will be handled in the courts or dispute-resolution forum available under applicable law.

Where permitted by law, disputes must be brought individually and not as part of a class, collective, or representative action.

SECTION 22 - UPDATES TO THESE TERMS

We may update these Terms by posting a revised version on this page. The updated Terms apply after they are posted, except where a different effective date is stated or applicable law requires otherwise.

Your continued use of the service after updates are posted means you accept the updated Terms.
